Thank you for using Kinily. These Terms of Service (“Terms”) govern your use of our website at kinily.com, our mobile applications, and related services (collectively, the “Services”). By using the Services, you agree to these Terms and our Privacy Policy.

Definitions

  • Kinily, we, us, or our means the operator of the Kinily platform.
  • You or your means the person or household using the Services, including account owners and invited family members.
  • Account means a family or household workspace on Kinily that may include multiple users.
  • Content means information you or other account members submit to the Services, including events, todos, notes, recipes, meal plans, and forwarded emails.

Account Terms

  • You must be at least 13 years old to create an account. If you add information about children under 13 to your account, you represent that you are their parent or legal guardian and have authority to do so.
  • You are responsible for maintaining the security of your account credentials and for all activity under your account, including activity by family members you invite.
  • You must provide accurate registration information and keep it up to date.
  • We recommend enabling two-factor authentication where available.
  • Accounts registered by bots or automated means are not permitted.
  • The account owner is responsible for managing invitations and who has access to household data.

Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation
  • Upload or transmit malware, spam, or harmful code
  • Attempt to gain unauthorized access to the Services or other users’ accounts
  • Harass, abuse, or threaten others
  • Infringe intellectual property or privacy rights
  • Reverse engineer or scrape the Services except as permitted by law
  • Use the Services for any unlawful, fraudulent, or abusive purpose

We may suspend or terminate accounts that violate these Terms.

Subscriptions and Payment

Some features may be available at no charge; others may require a paid subscription. If you subscribe to a paid plan:

  • Fees, billing intervals, and any free trial terms will be shown at checkout
  • Payment is processed by our payment provider (such as Stripe); we do not store full payment card numbers
  • Subscriptions renew automatically unless you cancel before the renewal date
  • Prices may change with at least 30 days’ notice to the email on your account
  • Taxes may apply where required by law

We do not sell your personal information. Free and paid plans are subject to the same privacy commitments described in our Privacy Policy.

Cancellation and Termination

You may cancel a paid subscription through your account billing settings or by contacting support. Cancellation stops future charges; you retain access through the end of the current billing period unless otherwise stated at checkout.

You may delete your account by contacting support. Upon cancellation or deletion:

  • Your content becomes inaccessible from the Services immediately
  • We delete content from active systems within 30 days and from backups within 60 days
  • Deleted content cannot be recovered

We may suspend or terminate your access if you violate these Terms, if required by law, or if continued access poses a security or operational risk. Abuse or threats directed at Kinily staff may result in immediate termination.

Changes to the Services

We may modify, suspend, or discontinue any part of the Services at any time. We will provide reasonable notice of material changes that affect paid subscribers when practicable. We are not liable for modifications or discontinuation of features.

Privacy and Security

Your use of the Services is at your own risk. The Services are provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.

You agree that Kinily may process your data as described in our Privacy Policy. Our team may access your data only:

  • To respond to support requests (with your consent when accessing account content)
  • To diagnose and fix errors when automated recovery is not possible
  • To maintain security, prevent abuse, and investigate reported violations
  • When required by applicable law

We use third-party providers to operate the Services, including:

AI Features

Kinily Assistant and other AI-powered features are optional. When you use them, your inputs and relevant account context may be processed by third-party AI providers as described in our Privacy Policy. AI outputs may be inaccurate; you are responsible for reviewing information before relying on it. Do not use AI features to submit information you are not permitted to share.

Your Content

You retain ownership of Content you submit. You grant Kinily a limited license to host, store, process, and display your Content solely to provide the Services to you and your invited family members. You represent that you have the rights to submit Content and that it does not violate these Terms or applicable law.

We may remove Content that violates these Terms or that we are required to remove by law. We are not obligated to monitor Content but reserve the right to do so.

Intellectual Property

Kinily and its licensors own all rights in the Services, including software, design, and branding. You may not copy, modify, distribute, or create derivative works of the Services except as permitted by these Terms or with our written permission.

Limitation of Liability

To the fullest extent permitted by law, Kinily will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) one hundred U.S. dollars ($100).

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum extent permitted by law.

Indemnification

You agree to indemnify and hold Kinily harmless from claims arising from your use of the Services, your Content, or your violation of these Terms, to the extent permitted by law.

Disputes and Governing Law

These Terms are governed by the laws of the United States and the State in which Kinily is organized, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be resolved in the courts of that jurisdiction, unless applicable law requires otherwise.

Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on our website. Material changes will be communicated by email or in-app notice where appropriate. Continued use after changes take effect constitutes acceptance.
